1. RIGHT TO DISMISS

Any professional referred by Be Well Nursing Llc., and for any reason, proves incapable of performing the duties assigned, shall not be permitted to perform the service. In such instance, the client shall not be required to pay Be Well Nursing Llc., for hours not worked by the professional.

At the sole discretion of a Client, his or her designee, if anyone referred by Nurse Connection is incompetent, negligent, or has engaged in misconduct, the Client may require the individual to leave the premises and shall inform Be Well Nursing Llc., of this action immediately. The Client's obligation to compensate Be Well Nursing Llc., for such person's services shall cease from that point. In addition, the Client should send a written documentation of the material facts pertaining to the issue to enable Be Well Nursing Llc., to maintain attestation that the matter was handled fairly and professionally by all parties.

2. CLIENT RULES AND REGULATIONS

While providing services at a Client facility, our staff shall comply with all provisions of the licensing law under which healthcare professionals are licensed. The Client has the obligation to orient our staff to the premises and acquaint them with the existing Client's policies, procedures, and protocols.

3. INDEMNIFICATION

Be Well Nursing Llc., may indemnify and hold Client not responsible for claims for compensation, alleged to be due for services rendered on Client premises, as well as for claims by Federal, State, and Local Government Agencies, in connection with these services.

4. INSURANCE COVERAGES

Be Well Nursing Llc., operates in compliance with all State and Federal Laws applicable to employees. Each Client may be named as additional insured on all policies. Be Well Nursing Llc., maintains the following insurance coverage:

1. WORKERS' COMPENSATION
2. GENERAL LIABILITY
3. PROFESSIONAL LIABILITY
